Throughout history, inventions have enabled significant changes and developments in civilization. Despite resistance from the status quo, time has repeatedly shown that change and progress are ultimately best for humanity.
The invention of money and the stock market created an economic order that enabled the rise of the bourgeoisie. These changes ended feudalism and serfdom, laying the foundations for a human-centered modern world. Technological advancements brought about by the positive sciences ensured that equality became a norm, leading to the complete abolition of slavery. Unfortunately, in football governed by a small elite group this change occurred much later compared to other sectors of society.
Until 1995, professional footballers did not have the freedom to move to the team of their choice even after their contracts expired. If their current clubs offered them a new contract, they were obliged to accept it. Once you signed with a club, you effectively surrendered your free will. Jean-Marc Bosman was a Belgian professional footballer who played under this semi-feudal system.
In 1990, after his contract with RFC Liège ended, Bosman wanted to transfer to the French club Dunkerque. However, his club was furious about this request and demanded a hefty fee from Dunkerque to allow the transfer. Dunkerque rejected these absurd demands. Angered by this process, RFC Liège offered Bosman a contract 70% lower than his previous one, and according to FIFA regulations, Bosman was required to accept it. Determined to challenge this archaic system, he sued FIFA’s rule at the European Court of Justice on the grounds of restraint of trade.
The European Court of Justice ruled in favor of Bosman and issued what is still known as the Bosman Ruling. Today, the hundreds of millions in transfer fees and the multi-billion-dollar salary contracts stem from Jean-Marc Bosman’s solitary legal battle.
Before the Bosman Ruling, playing football was often a short-lived pursuit that brought fame but not long-term career security. Many families not only failed to support their children’s dreams of becoming footballers they actively opposed them.
The ruling significantly reduced club dominance over players, leading to increased salaries. More young players began pursuing football careers, supported by their families, turning football into a viable profession. Youth academies filled with talent, and new stars emerged by the thousands.
Great talents became idols, contributing to broadcasting rights deals worth billions. Today, two of the most followed individuals on Instagram and four of the five most followed athletes are footballers, with a combined following of over one billion.
This transformation extended beyond player wages. The skyrocketing salaries drew massive media attention to football. Before the early 1990s, it was rare to see a player’s name on a jersey the teams were the heroes, not the individuals. Post-Bosman, with the spirit of the times and increased media coverage, players became the true stars of the game.
Jean-Marc Bosman, at the cost of his own career, gave us the game we know today. Our gratitude to him endures. Just as a single thread-weaving machine patent paved the way for the Industrial Revolution, the Bosman Law was the most significant step in the industrialization of football.
